Confidentiality

Section 504 states that any information regarding a person's disability gained from medical examinations through appropriate post-admission investigation shall be considered confidential and shall be shared with others within the college or university on a need-to-know basis. Faculty/Supervisors do not need to have information regarding a students or employees disability, only information on the need for accommodations. Information regarding a student or employee’s disability is kept in the office of the ADA Coordinator in a secured file.

Reasonable Accommodation

Reasonable accommodation is any change to the known physical or mental limitations of a qualified employee with a disability unless it can show that the accommodation(s) would cause an undue hardship on the operation of the University. Jackson State University is not required to lower quality or quantity standards to make an accommodation. Nor is it obligated to provide personal use items, such as glasses or hearing aids, as accommodations.

Undue Hardship

Jackson State University is not required to provide accommodation if it will impose an undue hardship on its operation. Undue hardship is defined by the ADA and the Rehabilitation Act as an action that is:

"excessively costly, extensive, substantial, or disruptive, or that would fundamentally alter the nature of operation of the business."

In determining undue hardship, factors will be considered including the nature and cost of the accommodation in relation to the size, the financial resources, the nature and structure of the University's operation, as well as the impact of the accommodation on the specific facility providing the accommodation. Undue hardship will be evaluated on a case-by-case basis.
