The Americans with Disabilities Act (ADA) of 1990,
which took effect July 26, 1992, prohibits discrimination based
on disability in employment, public services, public accommodations,
telecom-munications, and transportation. The Rehabilitation Act
of 1973, Section 504, prohibits discrimination against the disabled
in any institution receiving federal funds. The act requires affirmative action in employing the disabled. The two acts, contain the same
basic goals, legal principles, and definitions. Under the ADA and
Rehabilitation Acts, an individual with a disability is a person
who has:
- .A physical
or mental impairment that substantially limits one or more major
life activities;
- Has a record
or history of a substantially limiting impairment
- Is regarded
as having a substantially limiting impairment.
To
be protected under ADA or the Rehabilitation Act, an individual
must have a record of, or be regarded as having substantial, as
opposed to minor impairment. A substantial impairment is one that
significantly limits or restricts a major life activity such as
hearing, seeing, speaking, breathing, performing manual tasks, walking,
caring for oneself, learning, or working. Jackson State University
offers support services for students, and employees with documented
disabilities, or that is regarded as having a substantial disability
is coordinated by the ADA Coordinator.
The
ADA Coordinator organizes, administers, and facilitates the delivery
of a broad range of educational and employment related support services,
policies and procedures for students, employees, and campus visitors
with disabilities.
